This Privacy Policy explains how Esquire Enterprise Solutions, LLC (the "Platform," "we," "us") handles information when you use this application portal to submit a housing application to a building and its managing agent (the "Building"). The Platform processes applicant information on behalf of the Building; the Building controls its own application requirements and decisions.

1. Information we collect

• Identity and contact details you or your representatives provide: name, email, phone, role in the transaction, and unit.
• Application contents you upload: forms, financial statements, tax returns, reference letters, and any other documents the Building requires. These commonly contain sensitive personal and financial information.
• Payment information. Payments are processed by Stripe. We receive payment status, amounts, and transaction identifiers; we do not receive or store your card number.
• Activity records. A timestamped audit log of actions on your application (submissions, uploads, notices, acknowledgments), including the IP address used, kept as the legally required record of the application process.

2. How we use information

• To prepare, transmit, and track your application for the Building and its managing agent.
• To send the notices the law requires (for example, acknowledgment and decision notices under NYC Local Law 58 of 2026) and related status emails.
• To process payments, holds, refunds, and fee records.
• To maintain the statutory compliance and audit record of the application.
• To operate, secure, and improve the Portal.

We do not sell your personal information, and we do not use your application contents for advertising.

3. Who we share it with

• The Building and its authorized reviewers: the managing agent, board members, and professionals they engage (such as counsel or screening vendors). This is the purpose of the Portal.
• Service providers that host and operate the Platform under contractual safeguards: cloud storage and infrastructure, email delivery, and Stripe for payments.
• Legal process and safety: when required by law, subpoena, or a government agency (for example, records produced in an HPD enforcement proceeding), or to protect rights and safety.

4. How long we keep it

We retain application records for the duration of the application and afterward for as long as the Building reasonably requires them as its statutory compliance record (including limitation periods for enforcement proceedings), and then dispose of them securely. Documents no longer needed for those purposes are deleted under our retention schedule. You may ask the Building's managing agent about the retention applied to your application.

5. Security

We maintain administrative, technical, and physical safeguards consistent with the New York SHIELD Act: we encrypt documents in transit and at rest, restrict access to the Building's authorized reviewers and platform personnel with a need to know, log access, and vet service providers. No system is perfectly secure; if a breach affecting your private information occurs, we will notify you as required by New York law.

6. Your choices and rights

• You can review the materials you submitted through your private application link while it is active.
• You can ask the Building's managing agent to correct application information or to tell you whether a consumer report was requested (and by which agency).
• You can withdraw your application at any time before a decision.
• You may request paper copies of materials from the managing agent.

7. Text messaging

Residents and applicants may choose to receive text messages from their building through the Platform, such as account setup invitations, maintenance and service notices, package alerts, and building announcements. By providing your mobile number through your building's portal or to your building's management, you agree to receive recurring text messages from your building through the Platform. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for assistance.

We collect your mobile phone number and your messaging consent solely to deliver the notifications described above. We do not share, sell, or otherwise provide your mobile phone number or your messaging consent information to any third parties or affiliates for marketing or promotional purposes.

8. Children

The Portal is not directed to anyone under 18, and we do not knowingly collect information from children.
