These Terms of Use ("Terms") govern your use of this application portal (the "Portal"), operated by Esquire Enterprise Solutions, LLC (the "Platform," "we," "us"). The Portal lets you prepare, pay for, and submit a housing application to a cooperative or condominium building and its managing agent (together, the "Building"). By starting an application, using a private application link, or making a payment through the Portal, you agree to these Terms. If you do not agree, do not use the Portal.
The Platform provides software that transmits, stores, and tracks application materials on behalf of the Building. The Building — not the Platform — sets the application requirements and fees, reviews your application, and makes all decisions on it. The Platform is not a law firm and does not provide legal advice; it is not a real estate broker; it is not a consumer reporting agency and does not order, review, or act on credit or background reports; and it is not a party to your purchase, transfer, or lease transaction. No attorney-client, fiduciary, or agency relationship is created between you and the Platform.
Access to your application is through a private link sent to you or your representative. The link is personal: do not forward or share it. Anyone holding the link can view and act on your application. Links expire and are disabled when the application is decided or withdrawn. Tell the Building's managing agent immediately if you believe your link has been used by someone else.
You consent to conduct this application electronically, including receiving records and giving acknowledgments by electronic means, under the federal ESIGN Act and the New York Electronic Signatures and Records Act. When you check an acknowledgment box in the Portal, that action is your electronic signature and we keep a record of it (including the date, time, and version of the materials you acknowledged). You may request paper copies of application materials from the Building's managing agent at any time, and you may withdraw consent to electronic dealings by contacting the managing agent — though doing so may delay or prevent processing through the Portal. Statutory notices that the law requires to be sent by particular means (for example, by registered mail) will be sent by those means.
You are responsible for the accuracy and completeness of everything you submit, and you confirm you have the right to submit it. You grant the Platform a limited license to store, transmit, and display your materials solely to process your application for the Building, maintain the statutory compliance record, and operate the Portal. The Building and its authorized reviewers (managing agent, board, counsel, screening vendors they engage) will have access to your materials.
A consumer report (credit and/or background check) may be requested by the Building or its managing agent in connection with your application; upon request you will be told whether a report was requested and given the name and address of the consumer reporting agency. The Platform does not request consumer reports. Applications are required to be evaluated in accordance with all applicable federal, New York State, and New York City fair housing and human rights laws. Concerns about screening or discrimination should be directed to the Building's managing agent, the NYC Commission on Human Rights, or the NYS Division of Human Rights.
Statutory deadline dates and status information shown in the Portal are computed from recorded events under applicable law (including NYC Local Law 58 of 2026) and are provided for information only. They are not legal advice and do not modify any legal right or deadline. Consult your own attorney about your rights.
Do not misuse the Portal: no unlawful, fraudulent, or infringing content; no attempts to access other applicants' or buildings' data; no interference with the service; no automated scraping. We may suspend access that threatens the security or integrity of the Portal.
THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE PLATFORM DOES NOT WARRANT THAT ANY APPLICATION WILL BE ACKNOWLEDGED, REVIEWED, OR APPROVED, OR THAT ANY PARTY WILL MEET ANY DEADLINE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE PORTAL WILL NOT EXCEED THE DIGITAL SUBMISSION FEE YOU PAID FOR THE APPLICATION GIVING RISE TO THE CLAIM, AND THE PLATFORM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR THE ACTS, OMISSIONS, OR DECISIONS OF ANY BUILDING, BOARD, MANAGING AGENT, OR SCREENING VENDOR. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
You may withdraw your application through the Portal before a decision; withdrawal disables your link and triggers the payment treatment in Section 4. We may discontinue the Portal for a Building at the Building's direction; your application record is retained per our Privacy Policy.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New York City, and you consent to their jurisdiction.
We may update these Terms; the "Last updated" date above will change and material changes will be reflected in the Portal. Questions about these Terms: support@esqenterprise.com. Questions about a Building's requirements, fees, or decisions: the Building's managing agent.
